By entering this Contest, each participant accepts and agrees to be bound by the following Contest Rules:
1. How to Enter: An individual may qualify to become a participant in the Contest by (i) completing an online registration by logging onto www.owens.edu , www.925kissfm.com , www.wiot.com or www.1037wcky.com and correctly answering the three (3) questions; or (ii) completing the paper copy entry form available at Owens Community College or Clear Channel Studios, 125 S. Superior, Toledo or Clear Channel Studios, 1624 Tiffin Ave., Findlay and correctly answering the three (3) questions.
2. Contest :
Registration - Online or paper copy entries may be submitted from Monday, June 30, 2008 through 11:59 p.m. EST , Monday, July 28, 2008 . Sponsors are not responsible for lost, late, illegible, misdirected or mutilated entries.
Final – The first final will be held at the Owens Community College Findlay-area Campus beginning at 3 p.m. Tuesday, Aug. 5 in the Community Education and Wellness Center . One grand prize and one runner-up prize will be awarded that day.
All-non winners will be eligible to attend the second final at the Owens Community College Toledo-area Campus beginning at 3 p.m. Thursday, Aug. 7 at the Student Health and Activities Center , where the second grand prize and runner-up prize will be awarded.
3. Prizes .
2 Grand Prize Winners – Two grand prize winners will receive one-year tuition (2 consecutive semesters) to Owens; maximum value of each grand prize is based on current in-state tuition of $123 per credit hour: $1,476 per semester or $2,952 in FY09. The prize does not include registration, parking, testing or laboratory fees or books and supplies.
2 Runners-up – Each runner-up will receive one semester of tuition to Owens, maximum value of $1,476, based on current in-state tuition of $123 per credit hour. The prize does not include registration, parking, testing or laboratory fees or books and supplies.
Secondary Prizes – Bookstore Gift Cards, food, CD, T-shirt and other comparable prize packs will be awarded at both finals.
Prizes are not transferable, redeemable for cash or exchangeable for any other prize. The grand prize must be completely redeemed by June 30, 2009 . The runner-up prizes must be redeemed by June 30, 2009 . If a winner cannot be contacted or winner is disqualified for any reason, the Clear Channel and Owens Community College , in their sole discretion, reserve the right to determine an alternate or not to award that winner's prize. The value of the prizes to the individual winners shall not exceed the dollar amounts listed above, regardless of the winner's residency. The odds of winning depend upon the number of participants.
4. Eligibility and Limitations . Participants and winners must be at least 16 years old. A legal parent or guardian of any participant who is a minor must sign a release on behalf of the minor in order for such minor to participate and to claim any prize(s). Clear Channel and Owens Community College reserve the right to refuse to award any prize to or on behalf of any minor. No Purchase Necessary. This Contest is v oid where prohibited. Only one (1) entry per person. In addition, only one (1) prize per household from any of the Clear Channel's stations within any thirty (30) day period will be awarded. Employees of the Clear Channel Company, Owens Community College , and their advertising agencies, members of the Owens Community College Board of Trustees, Owens Community College Foundation or Owens Community College Alumni Association, employees of other radio stations, and members of the families of any such persons listed above are not eligible to participate or win. The term “family” shall include the spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
5. Telephone and Delivery Disclaimer . If a contest is a call in to win contest and/or a telephone is needed to participate in the Contest, participants are restricted to the use of ordinary telephone equipment. Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number if prompted, or the participant disables the feature inhibiting the Station's ability to identify the caller. Participants using equipment not set up for toll free phone exchanges (800, 888, 877, 866, etc.) may experience call connection problems. The Clear Channel Company and all other Parties disclaim all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Company's control, or otherwise. The Parties disclaim all liability for any delays, failed delivery, loss or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including, but not limited to: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.
6. Publicity; Use of Personal Information . By participating, where allowed by law, all participants and winner(s) grant the Clear Channel Company and Owens Community College exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Clear Channel Company and Owens Community College may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
7. Release . By participating in the Contest, each participant and winner waives any and all claims of liability against the Clear Channel Company and Owens Community College, their respective employees and agents, Owens Board of Trustees, the Ohio Board of Regents, Owens Community College Foundation and Owens Community College Alumni Association board members for any personal injury or loss which may occur from the conduct of, or participation in the Contest, or from the use of any prize(s). In order to receive a prize, participants must sign an official waiver form provided by the Clear Channel Company and Owens Community College .
8. Taxes . Any valuation of the prize(s) stated above is based on available information at the inception of the Contest. The value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide Owens Community College with valid identification and a valid taxpayer identification number or social security number before any prize(s) will be awarded. Any person winning prize(s) valued over $600 from Owens Community College or the Clear Channel Company in any calendar year will receive an IRS Form 1099 and a copy of such form will be filed with the IRS.
9. Conduct and Decisions . By participating in the Contest, participants agree to be bound by the decisions of Owens Community College and Clear Channel Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. Owens Community College and the Clear Channel Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest. Owens Community College and the Clear Channel Company's joint decisions concerning such disputes, interpretation of the Contest rules or any other decisions related to the Contest shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Clear Channel Company or Owens Community College, the Clear Channel Company and Owens Community College reserve the right to terminate this Contest, or make such other decisions regarding the outcome as the Clear Channel Company and Owens Community College deem appropriate. The Clear Channel Company and Owens Community College may amend or waive any of these rules in their sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Miscellaneous. Each winner must submit proof of eligibility and sign the Clear Channel Company and Owens Community College release form(s) to claim their prize(s). The Clear Channel Company and Owens Community College may substitute prizes or discontinue the Contest at any time as announced on the Stations and on Owens Community College Web site. The Clear Channel Company and Owens Community College disclaim any responsibility to notify participants of any aspect related to the conduct of the Contest. To obtain a copy of these rules, or where required by law, a list of winners, visit the business office of the Clear Channel Company during normal business hours or mail a written request with a stamped, self-addressed return envelope to 125 S. Superior Street, Toledo, OH 43602. All entries become the property of the Clear Channel Company and Owens Community College and will not be returned.
• Financial Standing. A Contest participant must not have a delinquent outstanding account balance with Owens Community College and must be compliant with federal financial aid laws in order to receive the Grand Prize or Runner-up Prize(s).
12. Compliance with Law . The conduct of the Contest is governed by the applicable laws of the State of Ohio , which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
